First DCA strikes CMPA brief
Florida’s First District Court of Appeals today granted a motion to strike the Community Maritime Park Associates’ answer brief in the ongoing Keesler v. CMPA lawsuit.
The CMPA’s answer brief was prepared by Matthew Bush, a junior attorney at the firm of CMPA attorney Ed Fleming, in response to the appellate brief filed by Sharon Barnett, attorney for Byron Keesler and Leroy Boyd. Messrs. Keesler and Boyd filed suit against the CMPA last year over the CMPA’s repeated violations of Florida’s Sunshine laws.
Ms. Barnett filed a motion to strike the CMPA’s answer brief, contending that the brief was argumentative, lacked legal citations, and didn’t contain a concise summary of the defense’s argument. The CMPA now has until November 20 to file an amended brief.
